DARTFORD. POLICE COURT - SATURDAY.
Eliza Ann Horton of the "King's Head Inn," Dartford, was summoned for
selling to P.C. Dengate, on 29th January, a quantity of whiskey and
brandy not of the quality demanded, the former, according to the
analyst's certificate, being 28.2 under proof and the latter 28.61. The
legal limit is 25 under proof.
Mr. Ridley, for Mrs. Horton, urged that
proof spirit, according to an act of George 3rd., was, roughly speaking,
50 degrees of pure alcohol and 50 degrees of water. Thus water could not
be a foreign ingredient for adulteration, and the analyst had gone
outside his function to prejudice what it was the duty of the
magistrates to decide.
Defendant was fined £1 and costs on each
summons. |
