LICENSING BOARD – 18 AUGUST 1999.

4. Application for renewal of the indoor public entertainments licence for The Star Inn, 16 Station Road, Lydd.

Mr. M T Robinson, the applicant, spoke at the meeting in support of the renewal of his licence. He asserted that more noise nuisance was caused by events being held in the Lydd Memorial Hall next door to his premises than was created by the entertainments held at The Star Inn. He claimed that no complaints had been received from people living at the rear of his premises, despite the fact that the back door was frequently left open to improve the circulation of air in the premises. The front door and windows were always kept closed. He would not agree to installing a noise monitor because such equipment was too expensive and live bands were unwilling to play in premises where they were installed.

The Health Officer reported that the design and location of the building meant that the management was all important, particularly during the summer months when neighbours’ windows and doors were open. Monitoring had taken place and music was found to be audible in adjacent properties when doors and windows were shut. When the doors of The Star Inn had been opened there was a perceptible increase in noise to an intrusive level. He reported that at the last event when monitoring had taken place, the noise of the music was acceptable, proving that it was possible to manage events effectively.

Objectors to the renewal of the licence, Mr. K Bolton, Mr. N V Heritage and Councillor Ms. V N Dawson expressed their concerns at the unacceptable level of noise.

Town Councillor, Mr. Allen spoke in support of the applicant, claiming that when entertainments were in progress, he had monitored the noise in surrounding streets and found that noise of traffic was much greater.

RESOLVED:- 1. To approve for a period of 9 months the renewal of the indoor public entertainments licence for The Star Inn, 16 Station Road, Lydd, the hours to be restricted to:- From 1 October to 31 April, Friday, Saturday and Bank Holidays 18.00hrs – 23.00hrs. 1 May to 30 September one event maximum on any weekend, Friday, Saturday and Bank Holidays 18.00hrs – 22.00 hrs notifiable to the Council 14 days in advance.
