CHARGE OF ASSAULT
David Evans was charged with assaulting Jessie Boyce. Mr. Lewis
appeared for the defendant.
From the statement of complainant it appeared that, between 10 and 11
o'clock on Monday night, she was at the "United Stores," in Snargate
Street, of which the defendant is the landlord, in the bar, talking to a
"military man." They were conversing about another soldier of pugilistic
proclivities. The landlady, believing that this was the subject of
conversation, and taking offence at some words she had overheard, she
rushed to the other side of the bar, and an altercation ensued. Mrs.
Evans ultimately knocked witness down, and they struggled together for
some time till the defendant intervened, taking witness up in his arms,
and throwing her out on Commercial Quay. She returned to the house
accompanied by a policeman, and the defendant and his wife again threw
her out of the house and she fell upon her head. In cross-examination
she admitted she had officiated as pianist to the defendant, but she
denied that she had miss-conducted herself by getting intoxicated and
making a disturbance in the house on this particular night.
Witnesses on both sides were examined, and ultimately the case was
dismissed.
